What is the legal notice period in Morocco?

Notice depends on seniority and category. Executives: 1 month (under 1 year), 2 months (1-5 years), 3 months (above 5 years). Employees and workers: 8 days (under 1 year), 1 month (1-5 years), 2 months (above 5 years). Notice can be waived against compensatory pay. During notice, employees are entitled to 2 paid hours per day of job-search leave (article 44).

How is severance calculated?

Severance (article 53) is computed by seniority slices on the reference hourly rate (monthly salary divided by 191): 96 hours per year for the first 5, 144 hours for years 6-10, 192 hours for years 11-15, and 240 hours per year above. The reference is the average gross salary over the last 52 weeks.

How many annual paid leave days in Morocco?

Annual leave is 1.5 working days per month worked, i.e. 18 days per year (article 231). Employees under 18 get 2 days per month (24 per year). A seniority bonus adds +1.5 days per 5 years of service, capped at 30 days in total.

What is the Moroccan SMIG in 2026?

The non-agricultural SMIG is 17.92 MAD/hour as of 1 January 2026, i.e. about 3,422.72 MAD/month on 191 hours. This is the second tranche of the 29 April 2024 tripartite agreement (+10% over two years). Agricultural SMAG reaches 97.44 MAD/day on 1 April 2026.

What are the overtime premium rates?

On the base hourly rate: +25% for ordinary day hours (06h-21h), +50% for ordinary night hours (21h-06h) or for a rest/holiday day during day hours, and +100% for night hours on a rest day or public holiday. Annual cap: 80 hours per employee, extendable to 100 after staff-delegate consultation. Pay is mandatory; no compensatory rest can substitute it (article 201).
