Notary fees in Morocco typically range from 6% to 8% of the property price. They include registration duties (4% for residential, 5% for land), land registry fees (1.5% + ~200 MAD), notary honoraires (1% to 1.5% progressive), 10% TVA on those honoraires, and flat stamps around 2,000 MAD.
Is there a difference between apartment, house and land?
Yes. Residential property (apartment, house, villa) is subject to 4% registration duties, while land and commercial property are taxed at 5%. The rest of the fees remain identical.
Are notary honoraires fixed or regulated?
Notary honoraires in Morocco are capped by Decree 2.17.481 (in force since 2019). The official ceiling is: 4,000 MAD flat under 300,000 MAD, 1.5% between 300,000 and 1,000,000 MAD, 1.25% up to 5 million, 0.75% up to 10 million, and 0.5% above. These are maximums, so notaries can charge less (in practice, honoraires often sit between 1% and 1.5%). Honoraires are subject to 10% TVA.
Who pays the notary fees in Morocco?
By law, all notary and acquisition fees are paid by the buyer unless the sale contract states otherwise. Fees are paid upon signing the final deed at the notary's office.
